Lawyer thinks real-life Martha DOES actually have grounds to sue Netflix over Baby Reindeer

So not only has Baby Reindeer’s real-life Martha outed herself, but she has also threatened to sue Netflix and Richard Gadd over the whole show.

Fiona Harvey said that as an Aberdeen law graduate, and now practising lawyer in London, she plans to represent herself in legal proceedings, and slammed Jessica Gunning, who plays Martha in Baby Reindeer on Netflix. “I have a claim against Netflix as this is being billed as part of a true story,” she said.

“I’m a highly competent lawyer. I’d have to do it myself. I’m very good. I have a photographic memory and can memorise huge files. I was top in my school at everything. People are probably saying I’m a mass murderer. This can’t continue. I will kick their asses.”

But would she have any actual chance of winning her case? It turns out a lawyer thinks she might.

Following her named and pictured interview with the Daily Record, Rory Lynch, a lawyer specialising in defamation and privacy at Gateley Legal, believes Fiona Harvey may have grounds to sue for defamation because people found out her identity using a method known as “jigsaw identification”. This is when you are able to identify someone by using bits of different pieces of information from two or more sources.

The lawyer said: “The only thing I can presume is that when Clerkenwell, films, the BBC and Netflix looked at it with their legal team they thought that they could rely on the fact that it is a drama. It’s not supposed to be a factual documentary. So although Netflix said it’s a true story, essentially it’s a dramatisation of a true story.”

“But I do think that Richard Gadd could have been a bit more careful in changing a lot of the scenes to be more fictitious, but also covering up the identity of the people it was based on.”

An expert criminologist has also revealed why they think the real Martha decided to publicly out herself and it’s allegedly all to do with her still wanting to be attached to him in some way.

Netflix and Richard Gadd have been contacted for comment.
