Emilie Kiser files second lawsuit to keep one specific document private after son’s death

Three-year-old Trigg tragically drowned on 12th May


Influencer Emilie Kiser has now filed a second lawsuit to keep further records surrounding her three-year-old son Trigg’s tragic drowning private.

She first sued Arizona officials on 27th May to stop information relating to the investigation from being publicly released, including things like the police report, body camera footage, scene photos, 911 calls and the autopsy report.

The family then filed a second motion to the Arizona Superior Court for Maricopa County on 3rd June to keep her “personal declaration” private. This is a detailed account written by the influencer which describes the event in full.

A source told People that the personal declaration “reflects an intensely personal account of her grief and trauma, submitted to help the court understand her perspective – not for public consumption”.

“The core legal issues remain fully transparent through public filings by counsel and the court. Emilie’s sealed declaration does not hinder the public’s understanding of the case or its legal significance,” they continued.

“Preserving a small measure of privacy in the midst of public scrutiny is a reasonable and compassionate choice given the circumstances.”

The toddler died in hospital on 18th May, six days after being pulled out of the swimming pool at their Arizona home six days earlier. He was in a critical condition at the Chandler Regional Hospital before being transferred to Phoenix Children’s Hospital.

Chandler Police Department spokesperson Sonu Wasu confirmed that a police investigation had been opened on 18th May, telling E! News: “Our thoughts and deepest condolences are with the child’s family and loved ones during this unimaginable time.”

“The investigation into the circumstances surrounding this incident remains ongoing. This is still an open investigation. Out of respect for the family’s privacy, we will not be releasing additional details until the investigation is closed,” they added.

According to the lawsuit, the City of Chandler and the Maricopa County Medical Examiner’s Office have received over 100 requests for access to records related to the three-year-old’s death.

A source told People this includes “requests for the footage of a toddler’s death, which only serves to satisfy morbid curiosity more than any type of justice”. Emilie Kiser has not publicly spoken out since the incident.
