‘Emilie is going through a parent’s worst nightmare’


Emilie Kiser’s lawyer has shared a statement in legal documents after the influencer sued Arizona officials over the investigation into her three-year-old son Trigg’s tragic drowning.

The 26-year-old filed a lawsuit to stop any information relating to the investigation from being publicly released, including things like the police report, body camera footage, scene photos, 911 calls and the autopsy report.

In the court documents obtained by NBC News, the family’s lawyer, who has not been named, shared the statement: “Emilie is going through a parent’s worst nightmare right now. She lost her young son.”

“Emilie is trying her best to be there for her surviving son, two-month-old Theodore. But every day is a battle,” they continued.

The attorney described the incident as a “heartbreaking accidental drowning” and added: “Emilie and her family desperately want to grieve in private, but sadly, the public will not let them. Trigg’s death has become a media frenzy.”

Trigg passed away in hospital on 18th May after being pulled out of a swimming pool at their Arizona home unconscious six days earlier. Paramedics performed CPR at the scene, and the toddler was then taken to Chandler Regional Hospital before being transferred to Phoenix Children’s Hospital.

On 19th May, Chandler Police Department spokesperson Sonu Wasu confirmed that a police investigation had been opened, telling E! News: “Our thoughts and deepest condolences are with the child’s family and loved ones during this unimaginable time.”

“The investigation into the circumstances surrounding this incident remains ongoing. This is still an open investigation. Out of respect for the family’s privacy, we will not be releasing additional details until the investigation is closed,” they added.

According to the lawsuit, allowing any documents to be publicly released would cause the influencer to suffer “irreparable harm” and turn Arizona’s Public Records Law into a “weapon of emotional harm” rather than a “tool of government transparency”.
