America’s Got Talent star suing Will Smith for alleged sexual harassment
His attorney has denied all the claims as 'false, baseless, and reckless'
Will Smith has been sued by Brian King Joseph, a former contestant on America’s Got Talent, for alleged sexual harassment, wrongful termination, and retaliation.
Will Smith’s attorney has “categorically denied” all the claims against him as “false, baseless, and reckless.”
Brian filed the suit on December 30th against Will Smith and Treyball Studios Management. He has accused Will of “predatory behavior” and “deliberately grooming and priming Mr. Joseph for further sexual exploitation” prior to his Based on a True Story: 2025 tour.
The lawsuit alleges that Will hired Joseph in November 2024 to perform at one of his shows in San Diego. It’s claimed that Will then invited Joseph to join his 2025 and play the violin on his upcoming album.
The lawsuit alleges that Will once told Joseph: “You and I have such a special connection that I don’t have with anyone else.”
Joseph claims that a “traumatic series of events” happened in Las Vegas in March 2025 where Will Smith was performing.
He claims that Will’s management accidentally lost Joseph’s bag, which contained the keycard to his hotel room. Joseph claims he found out that someone had entered into his hotel room with no signs of forced entry.
There was evidence found “of a sexual threat of violence” which allegedly included a handwritten note reading, “Brian, I’ll be back… just us,” with a drawn heart and signed, “Stone F.”
Joseph also found “wipes, a beer bottle, a red backpack, a bottle of HIV medication with another individual’s name, an earring, and hospital discharge paperwork belonging to a person unbeknownst to” Joseph.
He claims he “feared that an unknown individual would soon return to his room to engage in sexual acts.”
The incident was reported to hotel security alongside to representatives for Will Smith, alongside the non-emergency police line.
The lawsuit alleges that someone from Will’s management team “shamed” Joseph for the incident and informed he was being terminated whilst insinuating he had made the entire thing up.
Joseph claims he suffered “PTSD and other mental illness as a result of the termination.”
The complaint reads: “The circumstances of the hotel intrusion all point to a pattern of predatory behavior rather than an isolated incident.”
It adds that Joseph experienced “severe emotional distress, economic loss, reputational harm, and other damages” as a result of the alleged incident and the termination.
In a statement to People, Allen B Grodsky, an attorney for Will Smith denied all claims, stating: “Mr. Joseph’s allegations concerning my client are false, baseless, and reckless.
“They are categorically denied, and we will use all legal means available to address these claims and to ensure that the truth is brought to light.”
