CPS confirm no criminal prosecutions after the death of Durham student Olivia Burt

Her parents are ‘deeply disappointed’ after such a ‘lengthy investigation’


No criminal prosecutions will be brought following the death of Durham student Olivia Burt two years ago

Olivia tragically died on 7th February 2018 after a metal barrier outside Missoula nightclub collapsed on her. Olivia, 20, was in her first year reading Natural Sciences at University College.

Following a police investigation, the case was referred to the Crown Prosecution Service, where the charges of gross negligence manslaughter and corporate manslaughter were considered.

On 3rd September 2020, the CPS confirmed that the evidence to provide a realistic prospect of conviction against any individuals or companies for the offences linked to Olivia’s death was insufficient.

Olivia’s parents, Nigel and Paula Burt, commented: “Clearly we are deeply disappointed that after such a lengthy investigation, lasting more than two and a half years this decision has been reached. We hope that there will now be a thorough and independent investigation into whether any health and safety offences have been committed.”

An inquest into her death is yet to be concluded.
