Cornell files motion to dismiss sexual assault lawsuit

Cornell says John Doe has no basis for his claims against the university

Cornell University is currently attempting to have a pending lawsuit against the university dismissed.

The case was brought up by a male student, John Doe, because of the alleged mishandling of his sexual assault case.

Now John Doe is suing Cornell for refusing to investigate his report that he was sexually assaulted because of his gender.

“Cornell filed a motion to dismiss our petition,” said Alan Sash, the lawyer representing John Doe.

According to Cornell, the petition should be dismissed because no decision has yet been made regarding his “responsibility for the alleged sexual assault” and so his claims “are not yet ripe for judicial review.”

The motion added John Doe has no basis for his claim that Cornell acted “arbitrarily or capriciously” in trying to “investigate his claim of sexual discrimination against [Sarah Affel] the Title IX investigator.”

It said: “Cornell has provided a clear rationale for its decision to address his concerns after there is a final determination in the student case, during which case, he has a full opportunity to raise his concerns.”

The lawsuit on John Doe’s behalf is scheduled to take place on November 30.
